Terms

1. Subject of the Contract
These General Terms and Conditions govern the rental of the holiday villa San Remo, Dragonja 130, 52212, Valbandon, Croatia, to holiday guests. By submitting a booking request, guests acknowledge these terms and conditions.

2. Booking and Payment Conditions
2.1 Booking can be made through a request via the website, email, or phone. After the booking is confirmed by the landlord, a written booking confirmation will be sent by email.
2.2 With the booking confirmation, a deposit of 70% of the total amount is due via bank transfer. The deposit must be paid within 7 calendar days of receiving the booking confirmation to make the contract legally binding.
2.3 If the deposit is not received within the deadline, the landlord reserves the right to cancel the booking.
2.4 The remaining balance is due in cash upon arrival.


3. Cancellation Conditions

3.1 Cancellations by the guest must be made in writing (by email).
3.2 Cancellation fees:
• Up to 60 days before arrival: full refund of the deposit.
• 59 to 30 days before arrival: 50% of the deposit will be refunded.
• Less than 30 days before arrival: no refund of the deposit.
3.3 If the villa is unavailable due to unforeseeable circumstances, the guest will be informed immediately, and any payments already made will be fully refunded. Further claims are excluded.


4. Check-in and Check-out

4.1 Check-in is possible from 3:00 PM.
4.2 Check-out must be completed by 10:00 AM at the latest.
4.3 Deviations from these times require prior agreement with the landlord.


5. House Rules

5.1 Pets are not allowed in the villa.
5.2 Smoking is strictly prohibited inside the building. Smoking is only allowed in designated outdoor areas with provided ashtrays.
5.3 The maximum number of guests is 8 people and must not be exceeded, unless agreed upon with the landlord beforehand.


6. Deposit and Damages

6.1 Upon arrival, a deposit of €500 in cash is required.
6.2 The deposit will be refunded upon departure, provided no damage to the inventory or property is found.
6.3 Damages occurring during the stay must be reported to the landlord immediately, and if they exceed the deposit, the guest will be responsible for the costs.
6.4 In case of damage, the landlord will document the damage (e.g., photos or written description) and the guest will be informed immediately.
6.5 The repair or replacement of damaged items will be done by the landlord or a designated professional. The costs will either be deducted from the deposit or charged to the guest if they exceed the deposit.


7. Data Protection

7.1 The landlord collects and stores personal data (e.g., name, address, phone number, email address) solely for the purpose of processing the booking and in compliance with applicable data protection laws.
7.2 The data will be treated confidentially and not shared with third parties unless required by law or necessary for booking processing.
7.3 If no separate privacy policy is available on the website, these provisions apply as the basic data protection regulations. For more information, guests can contact the landlord directly.


8. Liability

8.1 The landlord is not liable for accidents, injuries, or damages occurring during the stay, unless caused by gross negligence or intent of the landlord.
8.2 The landlord is not responsible for the personal belongings of the guests.


9. Last-Minute Bookings

Last-minute bookings are those made 30 days or less before the planned arrival date.
9.1 For last-minute bookings, a deposit of 70% of the total amount is due immediately after receiving the booking confirmation. Proof of payment (e.g., transfer receipt) must be submitted by email no later than 48 hours before arrival.
9.2 If the deposit is not received on time, the landlord reserves the right to cancel the booking immediately. A later reinstatement of the booking is only possible upon proof of payment and subject to availability.
9.3 Last-minute bookings can be canceled in writing (by email) up to 48 hours before the planned check-in.
9.4 Cancellations within 48 hours of check-in will result in the full booking amount being due unless there is proof of force majeure (e.g., sudden illness, natural disasters). In such cases, the landlord may, at their discretion, offer a refund or credit for a future stay.
9.5 Guests who do not arrive at the agreed check-in time and have not communicated a cancellation will forfeit their right to the stay, and the full booking amount will be retained.


10. Final Provisions

10.1 Any changes or additions to the contract must be in writing.
10.2 The law of the Republic of Croatia applies. The jurisdiction is Pula, Croatia.
